Payroll tax compliance means following all applicable payroll rules, including:

Federal payroll taxes due dates
When are payroll taxes due? Taxes are due monthly or semi-weekly for most employers, but if you withhold $100,000 or more at any point during your regular deposit schedule, you must deposit the taxes by the next business day.
Very small employers may only need to make an annual payment; the IRS will notify you in writing if that schedule applies.
How to determine your payroll tax deposit schedule
New employers are automatically on a monthly deposit schedule, unless they qualify to make annual deposits. Reassess your deposit schedule at the beginning of every calendar year by looking at the payroll tax reported during the lookback period.
For calendar year 2026, the look-back period runs from July 1, 2024, to June 30, 2025:
- Make monthly deposits if you reported $50,000 or less in payroll tax during this period.
- Make semi-weekly deposits if you reported over $50,000 during this period.
Monthly payroll deposit due dates for 2026
Monthly deposits are due on the 15th of the month after you pay employees or the next business day if that date falls on a weekend or holiday.

Under the payroll tax deposit rules, you don't have to make a deposit if you didn't withhold any taxes.
Semi-weekly depositor schedule
Being a semi-weekly depositor doesn't necessarily mean you have to make deposits twice a week. It just means your deposits are due 3 to 5 business days after you pay employees. If you only pay employees once a month, you'll only make deposits once a month.
Semi-weekly deposits are due on Wednesdays or Fridays, depending on when you pay employees:
- If you pay employees on Wednesday, Thursday, or Friday, deposit taxes by the following Wednesday.
- If you pay employees on Saturday, Sunday, Monday, or Tuesday, deposit taxes by the following Friday.
If the due date falls on a holiday, it moves to the next day. Additionally, you always have at least 3 business days to make a deposit. If there's a holiday between the day you pay employees and your deposit deadline, you get an extra day. This generally only affects Tuesday or Friday payments.
For example, if you pay employees on Friday, May 22, 2026, your deposit deadline is on Thursday, May 28, 2026, because May 25, 2026 is a holiday.

2026 due dates for payroll tax and information returns
Employers must file payroll tax returns, federal unemployment returns, and provide employees with W-2 statements. These returns are not due the same day as deposits.
Quarterly and annual payroll returns
When are quarterly payroll taxes due? Both monthly and semi-weekly depositors must file Form 941 quarterly tax returns by the last day of the month following the end of the quarter or the next business day when the payroll deadlines fall on a weekend or holiday.

The best way to avoid penalties is to automate as much as possible. Don't weigh yourself down by manually making deposits, mailing in quarterly payroll returns, and trying to remember annual FUTA reports.
The IRS charges escalating penalties for late payroll tax deposits: 2% if you're 1 to 5 days late, 5% for 6 to 15 days late, 10% for 16 or more days late, and 15% if the taxes remain unpaid more than 10 days after the first IRS notice. Do federal holidays move due dates?
Yes, if payroll tax deadlines fall on a federal holiday, the due date moves to the next business day. Deadlines also move to the next business day if the due date falls on a weekend.
What counts as the pay date?
The day you pay employees is their pay date. It is either the day you give employees a check or the day of a scheduled direct deposit. It is not the day the funds leave your business account.
What is the three-day rule?
The three-day rule gives semi-weekly depositors at least 3 business days to deposit payroll taxes. If there's a holiday between the pay day and the due date, the deadline moves to the next business day.
