Xero Roadshow 2023 Australia - Terms & Conditions

  • The terms and conditions in Part 1 only apply to participants who register to attend live/ in-person events.
  • The terms and conditions in Part 2 apply to any participants who register to attend the virtual online event.
  • Any participants who choose to attend both the virtual and live events will be bound by both Parts 1 and 2 of these T&Cs.

Part 1: Live/In-person events - Terms and conditions

What's included?

Welcome to the 2023 Xero Roadshow Australia. Your registration includes entry for one person to the 2023 Xero Roadshow Australia on the date that you have booked. It also includes an invitation and ticket to the online event held on Thursday 2 March 2023 along with some of the virtual content on demand.

Terms and Conditions

1. You agree to the following terms and conditions (“Terms”), and any additional terms and conditions advised by Xero Australia Pty Ltd (Xero) to you from time to time for the Xero Roadshow Australia 2023 events (each an “Event”) to be held in person at various locations in Australia (“Event”).

2. Xero reserves the right to reject or accept your registration at any time in its absolute discretion. Acceptance of your registration is confirmed by Xero only when the acceptance is communicated to you by email.

3. You agree to comply with all reasonable instructions issued by Xero or venue management in relation to the Event.

4. You acknowledge that the material presented at the Event is subject to copyright and cannot be re-used without the written express permission of Xero.

5. All unauthorised photography and the recording or transmitting of audio or visual material, data or information is expressly prohibited. Any distribution of advertising or promotional material is expressly prohibited; only Xero approved exhibitors are permitted to distribute such material. Xero reserves the right to remove any attendee from the Event that fails to comply with these Terms.

6. During the Event, employees and/or representatives of Xero may be taking photographs and audio and visual recordings of the Event. Such photography and audio and visual recordings may include images and/or recordings of you, including any interview with you at the Event. You acknowledge and agree that your image and voice, and any interview with you, may be included without your permission and Xero may use such photography and audio and visual recordings in perpetuity for its own purposes, including advertising and marketing purposes, and that you will not be entitled to any compensation for the use or your image or voice in association with your attendance at the Event.

7. You will be provided with a Badge (“Badge”) to use at the Event. The Badge allows you to provide your personal details to exhibitors and other businesses (“Third Parties”) that may be represented at Xero Roadshow Australia 2023 (“Service”). You should only share information with Third Parties that you would like to hear from after the Event.

8. You acknowledge and agree that if you provide information to a Third Party using the Service, then the Third Party may use this information in accordance with its privacy policy. Xero makes no representations or warranties about how a Third Party may retain, use or disseminate your information.

9. If your Badge is misplaced or lost, please advise the Xero information counter.

10. Xero’s collection of your registration information will be used for the purpose of confirming your registration details for the relevant event(s). Xero will only use your personal information in accordance with its privacy policy which can be found on xero.com.

11. Xero reserves the right at any time to change the format, participants, content, location and timing or any other aspect of the Event, in each case without liability.

12. All guarantees, representations, conditions and warranties of any nature are expressly excluded. However nothing in these Terms limits, excludes or modifies or purports to do so, the guarantees as provided under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law. If these laws impose any inalienable consumer rights then to the extent of any inconsistency with these Terms, these Terms are to be read down to permit those rights.

13. To the maximum extent permitted by applicable law, Xero, its employees, agents and contractors will not be liable for personal injury or death, property damage, or any other loss (including without limitation, liability for negligence, breach of these Terms or any other agreement), damage, cost or expense (including, without limitation, loss of profits, business interruption, loss of information, indirect, special, punitive or consequential loss or damage) arising out of or in connection with the Event. This includes and is not limited to any losses associated with cancellation costs relating to travel, flights, accommodation, should the Event be cancelled.

14. Xero will not be in breach of these Terms to the extent that performance of its obligations is prevented by an event of force majeure (including, without limitation, an act of war, industrial action, civil disturbance, adverse weather conditions, natural disaster or other unforeseeable circumstances beyond Xero’s control).

CANCELLATION POLICY AND COVID-19 REQUIREMENTS

15. Xero may, in its sole discretion, cancel or postpone the Event for any reason. Where Xero does so it will notify You of such cancellation or postponement in writing. Xero is not responsible for, and will not be liable, for any of your costs associated with the Event or travel costs if the Event is cancelled or postponed.

16. Force Majeure: If the Event is cancelled or postponed for a reason outside of Xero’s control, including any act of God, natural disaster, fire, rain, wind, storm, earthquake, or any other unforeseen event or catastrophe, Xero will not be liable for any of your costs associated with the Event.

COVID-19 CANCELLATION RIGHTS

17. If Xero cancels the Event specifically as a result of governmental restrictions put into effect as a result of the COVID-19 pandemic (i.e., and does not run the Event as a virtual or hybrid virtual/in-person event), in no event shall Xero be responsible for reimbursing you for any other costs associated with the Event (including, but not limited to, travel expenses and accommodation).

Potential COVID-19 Vaccine and Related Requirements

18. In order to ensure the health and wellbeing of the Event attendees and staff, we may require you to provide evidence of your full COVID-19 vaccination status before you attend the Event. For example we may require you to show us your state or federal COVID-19 vaccination passport (demonstrating that you have had the COVID-19 vaccination), or proof of a recent negative test for the virus. We will endeavour to give you enough notice before the Event if we introduce this requirement. If any government authority or Venue requires us to see proof of your COVID-19 status before you attend the Event, we will also do our best to let you know about this in advance. We may restrict your access to the Event if we consider that there is a COVID-19 health and safety risk, either to you or to other attendees and staff of the Event.

19. In addition to the health and safety policies we communicate to you, you must comply with any law, regulation, order, ruling, decree, decision, recommendation or guidance of any government authority in connection with the COVID-19 pandemic.

XEROCON 2023 TICKET GIVEAWAY

20. All participants who attend an in-person Event (as defined in Part 1 of this Agreement) will automatically go in the draw to win one of 17 tickets to Xero’s Xerocon event to be held in Sydney on 23-24 August, 2023 at the Sydney International Convention Centre. The terms and conditions for that competition are set out below.

Part 1 - Schedule: Xerocon Sydney Giveaway Competition Terms and Conditions

1. The Xerocon Sydney 2023 ticket giveaway (Xerocon Tix Competition) is run on behalf of Xero Australia Pty Limited of 1/6 Elizabeth Street, Hawthorn VIC 3122 Australia (Xero), and is open from 10:00am AEST 20 January 2023 to 3pm AEDT 2 March 2023 (the Competition Period). Eligible Entrants (as defined below) who purchased an in-person Roadshow ticket between 21 November 2022 and 19 January 2023 will automatically go in the draw for the Xerocon Tix Competition. Xero may extend, cancel or amend this Competition and/or review and update these terms and conditions on its website at any time, at its sole discretion. By entering the Competition, you agree to be bound by these terms and conditions.

2. To be eligible to enter the Xerocon Tix Competition (Eligible Entrant), entrants must:

a) Be an Australian resident prior to, and for the duration of the Xerocon Tix Competition Period;

b) Be a Xero customer on any Xero subscription plan during the Competition Period and fall into one of the following categories:

  1. the Entrant’s Xero subscription is owned by a small or medium-sized business located in Australia prior to and during the Competition Period (Partner); or
  2. the Entrant’s Xero subscription is owned by a Xero accounting or bookkeeping partner which is located in New Zealand prior to and during the Competition Period (Partner); and
  3. Have registered for and attended an in-person Roadshow event.

3. Xero employees and their immediate family are not eligible to enter the Xerocon Tix Competition.

4. No payment is required in order to (i) register for and attend the events, or (ii) enter the Xerocon Tix Competition.

5. For the purposes of the Xerocon Tix Competition , an “Eligible Entrant” will be the Partner or Subscriber who owns the Xero billing account or is an employee within that organisation, and excludes any subscriber trialling an unpaid version of the Starter, Standard or Premium plan and any subscriber in arrears on their subscription payments (unless otherwise specified by Xero in writing).

6. There is a limit of one entry per Eligible Entrant.

7. The Xerocon Tix Competition comprises 17 individual Xerocon Tickets each valued at $1050 being awarded to 17 different Eligible Entrants, to be drawn at the end of the final in person Roadshow event (after 2 March 2023).

8. Eligible Entrants will have a chance to win 1 Xerocon Ticket to the 2023 Xerocon event to be held in Sydney at the Sydney International Convention Centre on 23-24 August 2023 to the value of $1050 each (Prize).

9. Each of the Prizes will be drawn using a random computer number generator via Xero’s Melbourne office at Unit 1/6 Elizabeth St, Hawthorn VIC 3122 from all correct entries following the end of the Competition Period and no later than 7 days after the Competition Period. The Eligible Entrants drawn at random through this process will each be deemed winners of the Competition (Winners).

10. The Winners will be notified using the contact details and email provided through the Xerocon TixCompetition registration process and the Winner’s Xero subscription. If we have made a reasonable attempt to contact a Winner, and a Winner has not responded within three (3) business days, or a Winner is unable to use the Prize, the Prize will be forfeited and Xero will randomly choose another Winner. In the event of any dispute, Xero’s decision is final.

11. The Winners will be notified by email no later than 7 days after the Competition Period.

12. Xero does not warrant that the Prize will meet the Winners’ requirements or that it will be suitable for any particular purpose. To avoid doubt, all implied conditions or warranties are excluded in so far as is permitted by law, including (without limitation) warranties of merchantability and fitness for purpose.

13. The Prize cannot be transferred to others, or exchanged for cash or other benefits and cannot be split. Winners must also arrange and pay for all of the associated travel and any accommodation costs to attend the Xerocon event in Sydney including any costs should that event be cancelled for any reason.

14. To the fullest extent permitted by law, Xero and its affiliated companies shall not be liable in any way (including, without limitation, in negligence), for any loss or damage whatsoever suffered (including, without limitation, direct, indirect or consequential loss), or for any loss or damage or personal injury suffered or sustained in connection with the Xerocon Tix Competition.

15. By accepting the Prize, the Winner agrees to participate in any publicity related to their Prize, and that Xero can use the Winners’ likeness, image and/or voice (including photograph, film and/or recording) in any media for an unlimited period of time without payment, to promote Xero and any of its other products.

16. By participating in the Xerocon Tix Competition and by submitting any contact details, each Participant consents to receive the latest news, special offers, promotions and information from Xero by email, TXT or other channels from time to time. If at any stage you do not want to receive this information then please let us know, or use the ‘unsubscribe’ feature on communications we send you.

17. The Winner agrees that Xero may withdraw the Winner’s right to their Prize if:

a) Xero’s name is, or is likely to be in Xero’s reasonable opinion, damaged or brought into disrepute or ridicule by the Winner or by being associated with the winner(s); or

b) The winner is involved directly or indirectly in any situation (whether the relevant situation occurred before, during or after the Competition period) which brings, or in the reasonable opinion of Xero is likely to bring, any of the winner, Xero or the Xerocon Tix Competition into disrepute, contempt, scandal or ridicule.

18. All use of Xero’s services is subject to Xero’s Terms of Use. Any personal information which we collect from you can be used in accordance with our Privacy Policy.

19. These terms and conditions are governed by the laws of the State of Victoria, Australia.

Part 2: Online event T&CS

Xero Roadshow Australia 2023 – Online Terms and Conditions

Xero Australia Pty Ltd (“Xero”, ”we”, ”us”) are excited to welcome you to Xero Roadshow Australia 2023 - Online.

1. These terms and conditions (“Terms”), and any additional terms and conditions advised by Xero to you from time to time, will apply to any Xero Roadshow Australia 2023 online event run by Xero (“Online Event”). When you register, you acknowledge and accept these Terms in full. If you are registering more than one person, you acknowledge and accept these Terms in full on behalf of each person included in your registration and confirm that you have consent from each person to disclose their personal information to us.

2. Xero reserves the right to reject or accept your registration at any time in its absolute discretion. If your registration is rejected by Xero, we will notify you by email.

3. You acknowledge that the material presented at the Online Event is subject to copyright and cannot be re-used in whole or part without the express written permission of Xero or its licensors.

4. All unauthorised photography and the recording or transmitting of audio or visual material, data or information is expressly prohibited.

5. During the Online Event, employees and/or representatives of Xero may be taking photographs and audio and visual recordings of the Online Event. Such photography and audio and visual recordings may include images and/or recordings of you, including any interview with you at the Online Event. You acknowledge and agree that your image and voice, and any interview with you, may be included without your permission and Xero may use such photography and audio and visual recordings in perpetuity for its own purposes, including advertising and marketing purposes, and that you will not be entitled to any compensation for the use or your image or voice in association with your attendance at the Online Event.

6. Xero reserves the right at any time to change the format, participants, content, location and timing or any other aspect of the Online Event, in each case without liability.

7. All guarantees, representations, conditions and warranties of any nature are expressly excluded. However, nothing in these Terms seeks to limit, exclude or modify your statutory rights.

8. To the maximum extent permitted by applicable law, Xero, its employees, agents and contractors will not be liable for personal injury or death, property damage, or any other loss (including without limitation, liability for negligence, breach of these Terms of any other agreement), damage, cost of expense (including, without limitation, loss of profits, business interruption, loss of information, indirect, special, punitive or consequential loss or damage) arising out of or in connection with the Online Event. This includes and is not limited to any losses associated with the cancellation of the Online Event.

9. Xero will not be in breach of these Terms to the extent that performance of its obligations is prevented by an event of force majeure (including, without limitation, an act of war, industrial action, civil disturbance, adverse weather conditions, natural disaster or other unforeseeable circumstances beyond Xero’s control).

10. Xero’s collection of your registration information will be used for the purpose of confirming your registration details for the relevant event(s). Xero will only use your personal information in accordance with its privacy policy which can be found on xero.com.

Part 2 - Schedule: 4 x $200 Prezzee Gift card and One Xerocon Ticket Giveaway Competition Terms

1. The Prezzee gift card and Xerocon ticket giveaway (Prezzee and Xerocon Competition) is run on behalf of Xero Australia Pty Limited of 1/6 Elizabeth Street, Hawthorn VIC 3122 Australia (Xero), and is open from 10:00am AEST 16 January 2023 to 5pm AEDT 2 March 2022 (the Prezzee and Xerocon Competition Period). Xero may extend, cancel or amend this Prezzee and Xerocon Competition and/or review and update these terms and conditions on its website at any time, at its sole discretion. By entering the Prezzee and Xerocon Competition, you agree to be bound by these terms and conditions.

2. To be eligible to enter the Prezzee and Xerocon Competition (Eligible Entrant), entrants must:

a) Be an Australian resident prior to, and for the duration of the Prezzee and Xerocon Competition Period;
