Terms & Conditions

No purchase or payment of any kind is required. A purchase, registration completion, or payment will not affect your chances of winning a prize. You have not yet won. Correctly answered mathematical skill-testing question required. The Contest is void where prohibited by applicable law or regulation.

1. This contest (Contest) is conducted by Xero Software (Canada) Ltd., with its registered office at Suite 2600, Three Bentall Centre, PO Box 49314, 595 Burrard Street Vancouver, British Columbia, V7X 1L3 (Xero, we, our or us) and by entering the Contest, an entrant (Entrant, you or your) agrees to be bound by these terms and conditions (the Terms).

Contest Period

2. The Contest is open from March 6, 2024 until March 27, 2024, 11:59pm PST (the Contest Period). Xero may, at its sole discretion, extend the Contest Period.

Eligibility

3. To be eligible to enter the Contest, an entrant must, at the time of the Contest: (a) be a legal resident of Canada (excluding Quebec); (b) have a physical address in Canada outside Quebec; and (c) be the age of majority in your province/territory of residence. You must have an email address and access to the public internet in order to enter the Contest. Eligibility for the Contest is subject to all applicable federal, provincial and local laws, rules and regulations. Employees of Xero, its affiliates, and members of their immediate families are not eligible to enter the Contest.

How to Enter

4. There are two (2) ways to enter the Contest, both of which are online. During the Contest Period, an Entrant must:

a. Enter via Webinar: register for and attend all four Bookkeepers’ Month webinars on March 6, 13, 20, and 27, 2024. You must attend at least 90% of the webinar, as determined by Xero in its sole discretion; or

b. Enter via Email: email [events.ca@xero.com] stating that you wish to be entered into the Contest.

5. Your entry must be received by Xero during the Contest Period. One entry per person. No purchase is required to enter the Contest.

6. Entries received other than during the Contest Period, duplicate entries, incomplete entries, entries that do not conform to or satisfy any condition of the Terms, and any entries received by automated means or means that subvert the entry process will be void. Xero will determine in its sole discretion what constitutes a valid entry. Proof of submission will not be deemed to be proof of receipt of entry by Xero. Xero has no obligation to notify you if your submission is void.

7. If you opt to access the Contest via your wireless mobile device, data rates or other charges may apply. Xero is not responsible for any charges or lack of functionality of wireless mobile devices. Xero expressly disclaims any and all liability related to your use of a third-party’s wireless mobile device (or other device) to access or participate in the Contest or to access any related online content.

Prizes and Timing

8. There is one prize available to be won in the Contest anywhere across Canada (excluding Quebec). The prize is two (2) tickets to XeroCon Nashville 2024 (approximate value of prize of $1,098 USD (the Prize). The Prize excludes travel and accommodations, which shall be the sole responsibility of the Winner.

9. The Prize is non-refundable, not redeemable for cash, not replaceable and non-transferable. Xero gives no warranties or representations regarding the Prize and it is provided on an “as is” basis. No prize substitutions, except by Xero, who reserves the right to substitute the Prize with another prize of equal or greater value if the Prize is not available for any reason as determined by Xero in its sole discretion. The odds of winning a prize depends on the number of eligible entries received during the Contest Period. Being a customer of Xero will not increase your chances of winning.

10. Xero will select one (1) Entrant at random from the entries that have met the Entry Criteria at or around April 1, 2024 (Winner). Xero will email the Winner to advise that they have won the Prize and advise as to how the Prize will be made available to them.

11. In order to receive their Prize, the Winner will be required to:

a. within seventy-two (72) hours of email notification, reply to Xero via email, confirming the Winner’s email address, full mailing address and phone number

b. correctly answer, without assistance of any kind whatsoever (whether mechanical or otherwise), a mathematical skill-testing question in no more than five (5) minutes;

c. sign and return a release form provided by Xero, which (among other things) confirms compliance with these terms and acceptance of the Prize; and

d. complete any additional documents (e.g., legal or tax-related documents) as provided by Xero in connection with the awarding of the Prize.

12. If the Winner (a) fails to complete the Prize Claim Steps; (b) is found to be ineligible by Xero; or (c) doesn’t comply with these Terms, or if any prize or prize notification is returned as undeliverable, then the Winner may be disqualified and an alternate Winner may be selected by Xero in its sole discretion.

13. Winner is solely responsible for any and all applicable federal, provincial, territorial, local or foreign taxes (and the reporting thereof), if any, and for all other unspecified expenses, incidental costs, fees, charges, or duties associated with acceptance or use of the Prize.

Other Terms

14. By entering the Contest you (a) agree to these Terms and Xero’s Privacy Notice; (b) consent to the collection, use and disclosure of your personal information for the purposes of administering the Contest; and (c) acknowledge and agree that your responses to the Survey will be collected and used by Xero in accordance with Xero’s Privacy Notice.

15. By entering the Contest, you consent to Xero and/or its affiliates using your name, place of residence, business, photographs, statements, digital image or recording for any publicity associated with the Contest without further payment or other compensation to you. You can object to your details being published or made available, or reduce the amount of information published or made available, by emailing privacy@xero.com. Note Xero may still be required to provide your details if required by law.

16. Xero’s decisions on all matters relating to the Contest (including without limitation, decisions regarding eligibility of Entrants and Winners, the awarding of the Prizes and the operation of the Contest) will be final and binding and no correspondence will be entered into. Xero reserves the right, in their sole discretion, to cancel, modify or suspend the Contest if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Contest.

17. Any attempt by an Entrant or any other individual to undermine the legitimate operation of this Contest may be a violation of criminal and/or civil laws. Should any such attempt be made, Xero reserves the right to seek remedies and damages to the fullest extent permitted by law.

18. Xero, its affiliates, and each of their respective directors, officers, employees, representatives, and agents (the Representatives) are not responsible for (a) technical failures of any kind, including but not limited to the malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, the Internet or any website; (b) any incomplete or inaccurate information, whether caused by equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; or (c) alteration, destruction or unauthorized access to entries.

19. To the extent permitted by law Xero, its affiliates, and each of their respective Representatives has no liability to you (including liability for any direct, indirect or consequential loss or damage) in connection with the Contest, your participation in the Contest, or acceptance, possession, or use or misuse of any prize. Notwithstanding anything to the contrary, without limitation, each Entrant agrees to fully indemnify Representatives from any and all claims by third parties relating to the Contest.

20. If there’s any part or provision of these Terms that is declared illegal or unenforceable by a court of competent jurisdiction, then the remainder of these Terms shall remain in full force and effect.

21. LinkedIN is not a sponsor or administrator of the Contest and the Contest is in no way endorsed by or connected to LinkedIN. You agree to a complete release of LinkedIN as it pertains to this Contest.

22. The Contest is governed by the laws of the Province of Ontario and the courts of the Province of Ontario shall have exclusive jurisdiction over any disputes relating to the Contest.
