Competition Terms and Conditions
No purchase or payment of any kind is required. A purchase, registration completion, or payment will not affect your chances of winning a prize. You have not yet won. The Competition is void where prohibited by applicable law or regulation.
1. This competition (Competition) is conducted by Xero Software (Canada) Ltd., with its registered office at Suite 2600, Three Bentall Centre, PO Box 49314, 595 Burrard Street Vancouver, British Columbia, V7X 1L3 (Xero, we, our or us), and is open from May 7th, 2024 at 9:00am EST and ends June 3rd, 2024 at 11:59pm EST (Competition Period). Xero may, in its sole discretion, extend or modify the Competition Period. By entering the Competition, an entrant (Entrant, you or your) agrees to be bound by these Terms and Conditions (Terms).
Eligibility
2. To be eligible to enter the Competition, an entrant must, at the time of the Competition: (a) be a legal resident of Canada (excluding Quebec); (b) have a physical address in Canada outside Quebec; (c) be the age of majority in your province/territory of residence; be either (d1) an accounting or bookkeeping practice or firm that held a Xero partner or business edition subscription between April 1, 2023 to March 31, 2024, or (d2) a long standing certified Xero app or new to the Xero App Store between April 1, 2023 to March 31, 2024; and (e) meet the requirements listed at xero.com/ca/events/xero-awards/2024/criteria for the awards categories (Award Category) you wish to apply. You must have an email address and access to the public internet in order to enter the Competition. Eligibility for the Competition is subject to all applicable federal, provincial and local laws, rules and regulations. Employees of Xero, its affiliates, and members of their immediate families are not eligible to enter the Competition.
How to Enter
3. In order to enter the Competition, an Entrant must complete and enter a valid entry form via https://awards.xero.com/ and complete the questions outlined for your Award Category (Response).
4. Your entry must be received by Xero during the Competition Period. One entry per Award Category per firm/practice or app partner. Entries received other than during the Competition Period, duplicate entries, incomplete entries, entries that do not conform to or satisfy any condition of the Terms, and any entries received by automated means or means that subvert the entry process will be void. Each Response must be submitted in good faith and based on real life experiences of the Entrant. Xero will determine in its sole discretion what constitutes a valid entry. Proof of submission will not be deemed to be proof of receipt of entry by Xero. Xero has no obligation to notify you if your submission is void.
5. If you opt to access the Competition via your wireless mobile device, data rates or other charges may apply. Xero is not responsible for any charges or lack of functionality of wireless mobile devices. Xero expressly disclaims any and all liability related to your use of a third-party’s wireless mobile device (or other device) to access or participate in the Competition or to access any related online content.
Prizes and Timing
6. Eligible Entrants will have a chance to win the following prizes:
6a. If selected as a Finalist;
- (1) ticket to Xerocon (estimated value $549 USD);
- Recognition as a Xero Award FY25 Finalist across the Awards website, blogs, and social media (estimated value $1,000 CAD);
- Social media kit to help promote themselves as a Finalist (estimated value $200 CAD);
(6a collectively as Minor Prize)
6b. If selected as a Winner:
- Recognition as a Xero Award FY25 Winner across the Awards website, blogs and social media (estimated value $1,000 CAD);
- Social media kit to help promote themselves as a Winner (estimated value $200 CAD);
- Award Trophy (estimated value $150 CAD);
- A two-day experience for one (1) nominated representative of the Winner to attend the Xero Awards Banquet in Toronto, Ontario, including but not limited to a workshop and dinner in October-November 2024. Xero will cover the nominated representative expenses for a round trip flight (domestic only), accommodations while in Toronto (to be determined and arranged by Xero), catering during the workshop and dinner, for the total value of up to $2,000 CAD.

7. Awardees are solely responsible for all costs not expressly listed as being included in the Prize (including the Major Prize), including without limitation, meals, entertainment, other travel and accommodation, incidentals, gratuities, services charges, optional extras, transfers, passports, visas, re-entry permits, spending money, freights, excess baggage, government taxes (all applicable federal, provincial, territorial, local or foreign taxes, and the reporting thereof), departure taxes, ground transportation any tax liabilities, airport charges, any applicable surcharges and any other related costs associated with acceptance of the Prize. Travel insurance is not included in the Prize and will be the responsibility of the Winner(s). Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The Winner acknowledges that the accommodation part of the Prize includes room charges only and no ancillary costs such as room service. Winners who attend the Awards Ceremony event must also comply with all reasonable safety directions from Xero staff prior to and on the day, including in order to comply with any COVID related government requirements that may be in place at the time. Xero will provide reasonable prior notice where any such requirements may be in place.
8. Prizes are non-refundable, not redeemable for cash, not replaceable and non-transferable (including, but not limited to, for sale, re-sale or auction). Xero gives no advice, warranties or representations regarding the Prizes and it is provided on an “as is” basis. No Prize substitutions, except by Xero, who reserves the right to substitute the Prize with another prize of equal or greater value if the Prize is not available for any reason as determined by Xero in its sole discretion. The odds of winning a prize depends on the number of eligible entries received during the Competition Period. Being a customer of Xero will not increase your chances of winning.
9. The Competition process and selection of finalists and winners from the Entrants (Finalist and Winners, collectively Awardees) will be overseen and managed by judges from Xero and external parties (Judges). Being a customer of Xero will not increase your chances of winning. For the purpose of determining each Awardee, the Judges will evaluate each Response according to its creativity, originality, and alignment to the awards criteria (each criterion weighted equally), as further detailed at xero.com/ca/events/xero-awards/2024/criteria (Awards Criteria). The Responses provided by the Entrants will be scored according to the criteria described in the Awards Criteria (with the top scoring being the best Response). The Winners and Finalist will be ranked, from which:
a. Twenty-seven (27) Finalists will be awarded the Minor Prizes; and
b. From the twenty-seven (27) Finalists, nine (9) will be awarded the Major Prize, with six (6) amongst accountants and bookkeepers and two (3) amongst Xero Apps.
10. There is a limit of one (1) Prize per Entrant; provided, Winners are awarded both Major and Minor Prizes. In order to receive their Prize, the Awardee will be required to:
a. within five (5) days from the date on which they are notified by email or phone, reply to Xero confirming the Awardee’s email address, full mailing address and phone number
b. sign and return a release form provided by Xero, which (among other things) confirms compliance with these terms and acceptance of the Prize; and
c. complete any additional documents (e.g., legal or tax-related documents) as provided by Xero in connection with the awarding of the Prize. (collectively, the Prize Claim Steps).
11. If the Awardee (a) fails to complete the Prize Claim Steps; (b) is found to be ineligible by Xero; or (c) doesn’t comply with these Terms, or if any prize or prize notification is returned as undeliverable, then the Awardee may be disqualified and an alternate Awardee may be selected having regard to the criteria set out above. Xero may also publish the Awardees’ names on its website. To the extent possible, Xero will arrange for the Prizes to be delivered to the Awardees.
Other Terms
12. By entering the Competition you (a) agree to these Terms and Xero’s Privacy Notice; (b) consent to the collection, use and disclosure of your personal information for the purposes of administering the Competition; and (c) acknowledge and agree that your Responses will be collected and used by Xero in accordance with Xero’s Privacy Notice.
13. By entering the Competition, you consent to Xero and/or its affiliates using your name, place of residence, business, photographs, statements, digital image, Response or recording to promote Xero and any publicity associated with the Competition without further payment or other compensation to you. Xero may be required to publish or make available details of the Competition, including the surname and region of each Awardee. You can object to your details being published or made available, or reduce the amount of information published or made available, by emailing privacy@xero.com. Note Xero may still be required to provide your details if required by law.
14. Xero’s decisions on all matters relating to the Competition (including without limitation, decisions regarding eligibility of Entrants and Awardees, the awarding of the Prizes and the operation of the Competition) will be final and binding and no correspondence will be entered into. Xero reserves the right, in their sole discretion, to cancel, modify or suspend the Competition if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Competition.
15. Any attempt by an Entrant or any other individual to undermine the legitimate operation of this Competition may be a violation of criminal and/or civil laws. Should any such attempt be made, Xero reserves the right to seek remedies and damages to the fullest extent permitted by law.
16. Xero, and the Judges, each of their affiliates and each of their respective directors, officers, employees, representatives, and agents (the Representatives) are not responsible for (a) technical failures of any kind, including but not limited to the malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, the Internet or any website; (b) any incomplete or inaccurate information, whether caused by equipment or programming associated with or utilized in the Competition, or by any technical or human error which may occur in the processing of entries; or (c) alteration, destruction or unauthorized access to entries.
17. To the extent permitted by law Xero, Representatives have no liability to you (including liability for any direct, indirect or consequential loss or damage) in connection with the Competition, your participation in the Competition, or acceptance, possession, or use or misuse of any prize. Notwithstanding anything to the contrary, without limitation, each Entrant agrees to fully indemnify Representatives from any and all claims by third parties relating to the Competition.
18. The Awardee agrees that Xero may withdraw the Awardee’s right to their Prize if:
a. Xero’s name is, or is likely to be in Xero’s reasonable opinion, damaged or brought into disrepute or ridicule by the Awardee or by being associated with the Awardee; or
b. The Awardee is involved directly or indirectly in any situation (whether the relevant situation occurred before, during or after the Competition Period) which brings, or in the reasonable opinion of Xero is likely to bring, any of the Awardee, Xero or the Competition into disrepute, contempt, scandal or ridicule.
19. If there’s any part or provision of these Terms that is declared illegal or unenforceable by a court of competent jurisdiction, then the remainder of these Terms shall remain in full force and effect.
20. LinkedIn, Instagram, Twitter and Facebook (Social Media) are not a sponsor or administrator of the Competition and the Competition is in no way endorsed by or connected to Social Media. You agree to a complete release of Social Media as it pertains to this Competition.
21. The Competition is governed by the laws of the Province of Ontario and the courts of the Province of Ontario shall have exclusive jurisdiction over any disputes relating to the Competition.
