Prize draw competition terms and conditions

1. This competition (Competition) is run on behalf of Xero (NZ company number 4123758), with its registered office at 19-23 Taranaki Street, Wellington 6011, New Zealand (Xero), and is open from 9am Monday 17th April 2023 to 11:59pm Sunday 25 June2023 (the Competition Period). Xero may extend, cancel or amend this Competition and/or review and update these terms and conditions on its website at any time, at its sole discretion.

2. For Xero certified accounting and bookkeeping partners to be eligible to enter the Competition

An entrant (Eligible Entrant) must be an owner or employee of a Xero certified accountant or bookkeeper located in New Zealand (Partner) for the duration of the Competition Period.

3. To enter the Competition, the Eligible Entrant must purchase a Xero Business Edition subscription or upgrade to a Xero Business Edition subscription using the relevant weekly promo code (in accordance with the relevant promo code terms and conditions) (Promo Code).

4. There is one (1) major prize to be won, consisting of:

• 2x Match Club hospitality tickets to the FIFA Women’s World Cup 2023™ final in Sydney on 20 August 2023
• Return flights for two (2) departing 19 August 2023 from Auckland, Wellington, Christchurch or Tauranga to Sydney, returning 25 August 2023
• Six (6) nights 4.5 star accommodation for two
• One (1) $500 Visa Prezzy card for spending money
• 2 x tickets to Xerocon 2023 in Sydney on 23 and 24 August (Major Prize)

5. There is also two (2) prizes, each a fun-filled goody bag (Prize), available in each of the following tiers of the Xero Partner Program (for a total of 10 Prizes):

a. Partners in the Starter tier or below;

b. Partners in the Bronze tier;

c. Partners in the Silver tier;

d. Partners in the Gold tier;

e. Partners in the Platinum tier;

6. The Eligible Entrant with the highest number of overall uses of Promo Codes during the Competition Period will win the Major Prize (Major Prize Winner).

7. The two (2) Eligible Entrants in each of the tiers listed in clauses 5 a.-e. with the most Promo Code uses during the Competition Period will be chosen as winners of the Prizes (each a Winner). For the avoidance of doubt, the Major Prize Winner will not be entitled to win a Prize in addition to the Major Prize.

8. The Major Prize Winner and the Winners will be notified by phone, or using any other contract details you give us, on or prior to 5pm on Friday 30 June 2023. If we have made a reasonable attempt to contact a Major Prize Winner or a Winner, and that Major Prize Winner or Winner has not responded within three business days, or that Major Prize Winner or Winner is unable to use the Prize, the Prize will be forfeited and Xero will choose the Eligible Entrant in the relevant tier with the next highest number of Promo Code uses during the Competition Period as the Major Prize Winner or Winner. In the event of any dispute, Xero’s decision is final.

9. Xero does not warrant that the Major Prize or any Prize will meet the Major Prize Winner or Winners’ requirements or that it will be suitable for any particular purpose. To avoid doubt, all implied conditions or warranties are excluded in so far as is permitted by law, including (without limitation) warranties of merchantability and fitness for purpose.

10. It is the Major Prize Winner's responsibility to ensure that all passport and/or visa requirements are met. Any additional travel costs required during the Major Prize Winner’s fulfilment of the Major Prize, including but not limited to, passport or visa costs, travel to a Main Centres, taxi or Uber charges, food and beverage costs or additional spending money are the responsibility of the Major Prize Winner.

11. The Major Prize or any Prizes cannot be transferred to others, or exchanged for cash or other benefits, and cannot be split.

12. To the fullest extent permitted by law, Xero disclaims any and all warranties (express or implied) including, without limitation, any implied warranties of merchantability. Xero and its affiliated companies shall not be liable in any way (including, without limitation, in negligence), for any loss or damage whatsoever suffered (including, without limitation, direct, indirect or consequential loss), or for any loss or damage or personal injury suffered or sustained in connection with the Prize or the Competition.

13. By accepting the Major Prize or a Prize, the Winner agrees to participate in any publicity related to their prize, and that Xero can use the Major Prize Winner or Winners’ likeness, image and/or voice (including photograph, film and/or recording) in any media for an unlimited period of time without payment, to promote Xero and any of its other products.

14. By participating in the Competition and by submitting any contact details, each entrant consents to receive the latest news, special offers, promotions and information from Xero by email, TXT or other channels from time to time. If at any stage you do not want to receive this information, please let us know, or use the ‘unsubscribe’ feature on communications we send you.

15. All use of Xero's services is subject to Xero's Terms of Use. Any personal information which we collect from you can be used in accordance with our Privacy Policy.

16. These terms and conditions are goverened by the laws of New Zealand.
